This chapter reviews the issue of when the condition of intellectual disability must be shown to exist in a court case involving diagnosis of ID in a death penalty case. The disability must be shown in childhood to meet the AAIDD definition of ID. It must be shown at the time of the crime in order to demonstrate that the defendant has lessened culpability. Different courts have different requirements about requiring the ID be diagnosed at the present time.
